CoJ, City Power say High Court did not consider all evidence in Eskom case

In response to a recent Johannesburg High Court order favouring State-owned utility Eskom in a payment dispute with the City of Johannesburg (CoJ) and City Power, the CoJ and City Power say the court did not fully consider critical aspects of the evidence. 

“While we accept and respect the court’s decision, the city reserve[s] the right to appeal the ruling,” the CoJ and City Power said in a June 21 media statement.

City Power alleged that, despite its efforts to engage in mediation and exhaust all intergovernmental relations dispute resolution processes to resolve the matter, Eskom had “bypassed these avenues and rushed to court to seek a resolution”.

City Power also pointed out that Eskom owed it R3.4-billion, which added to the complexity of the dispute.

An appeal has been lodged as the CoJ and City Power believe that a full bench would find differently.
